Is it possible to measure the dispersion of ex ante chances among people, be it gambling, health, or social opportunities? We explore this question and provide some tools, including a statistical test, to evidence the actual dispersion of ex ante chances in various areas, with a focus on chronic diseases. Using the principle of maximum entropy, we derive the distribution of the risk of becoming ill in the global population as well as in the population of affected people. In Popper’s exemplary exposition:The Utopian attempt to realize an ideal state, using a blueprint for society as a whole, is one which demands a strong centralized rule of a few, and which therefore is likely to lead to a dictatorship. [...] [Utopia] claims to plan rationally for the whole of society, although we do not possess anything like the factual knowledge which would be necessary to make good such an ambitious claim.2 [End Page 489]Yet, though this view of how Utopia, to recall Robert C. It involved an effort to reconcile western subjects to seismic and highly consequential shifts within postwar, late-capitalist societies themselves. If, as I have argued elsewhere, utopian fictions (and, indeed, nonfictions) before the Cold War period can be read as fictions of organization—of everything from architecture and urban planning, to production, sexuality and biological reproduction, clothing, or diet—it is also the case that in them, “organization” is a response, a reaction to traumatic historical experiences of disorganization, from the decline of the ancient city-state in the case of Platonic utopianism; to the impoverishment and dislocation of rural communities in the era of Thomas More; to the experience of the fracturing of religious community during the religious, civil, and international wars that marked the seventeenth century; to the dramatic impact of early nineteenth-century industrialization on artisanal and agrarian communities, on family cohesion and on the rhythms of the premodern working day.4My argument is, then, that the anti-utopian denunciation of blueprint and program was not simply motivated by the liberal capitalist attack against the planned and highly regulated character of economy and society in the countries of so-called actually existing socialism. It was also motivated by the ideological need to normalize and legitimize the transition, within western capitalist societies themselves, to what Scott Lash and John Urry called “disorganized capitalism.” Lash and Urry’s book, originally published during the decade of the triumphant rise of neoliberalism, in 1987, launches its investigation by tellingly quoting the passage of Marx and Engels’s Communist Manifesto that focuses on the creatively destructive aspects of capitalist social transformation: the bourgeoisie, Lash and Urry observe, is a class “with vested interest in change, crisis and chaos”; the social world over which it presides is one “which swings wildly out of control, menacing and destructive.”5 In their introduction, the authors outline the basic features of the postwar shift from the organized capitalism of the mid-nineteenth and early twentieth centuries to its disarticulated successor formation during the rise of [End Page 490] neoliberal governance. In this long-awaited book, Antony Duff offers a new perspective on the structures of criminal law and criminal liability. His starting point is a distinction between responsibility (understood as answerability) and liability, and a conception of responsibility as relational and practice-based. This focus on responsibility, as a matter of being answerable to those who have the standing to call one to account, throws new light on a range of questions in criminal law theory: on the question of criminalisation, which can (...) now be cast as the question of what we should have to answer for, and to whom, under the threat of criminal conviction and punishment; on questions about the criminal trial, as a process through which defendants are called to answer, and about the conditions (bars to trial) given which a trial would be illegitimate; on questions about the structure of offences, the distinction between offences and defences, and the phenomena of strict liability and strict responsibility; and on questions about the structures of criminal defences. The net result is not a theory of criminal law; but it is an account of the structure of criminal law as an institution through which a liberal polity defines a realm of public wrongdoing, and calls those who perpetrate (or are accused of perpetrating) such wrongs to account. Heidegger and Gadamer are typically read by different theologians. Heidegger tends to be read by philosophical theologians examining his contribution to matters of doubt, existential finitude, and atheism. Gadamer tends to be read by those with an interest in interpreting the Bible, especially by those with more confessional or epistemically optimistic sensibilities. In both cases, Heidegger and Gadamer have well-established associations with specific theological positions. Joshua Broggi challenges this arrangement by re-reading the primary texts as theological resources; he defends (...) an alternative theological appropriation of their philosophical work through a close engagement with portions of their argument. What emerges from Broggi's examination is an account of the unity of tradition, reason, and scriptural language. This account goes beyond claims of their relatedness, which are uncontroversial, and advances the stronger argument that they name the very same thing. Although initially counterintuitive, the central task set by both Heidegger and Gadamer is the investigation of that one phenomenon. This argument challenges the pervasive image in which Christians rely on 'tradition' to 'reason' about the meaning of 'scripture'. It puts into question the injunction that theologians should balance the resources of scripture, tradition, and reason. Broggi offers an account of Christian life as more fundamental than certain entities which are distilled out of it, namely: scripture, tradition and reason. (shrink)

In order to understand what we are talking about when we talk about joint attention, I will scrutinize how the mainstream view that builds on representational and intentionalist theories of mind is constituted. My aim is to show that much of the theory of joint attention is quite narrowly constructed and comes with tacit disciplinary biases that exclude much of what is existentially important in our practices of sharing our perceptions and guiding others to attend to the world in novel (...) ways. By using the frameworks of classical phenomenology and enactivist theories of mind, I aim to show how we, in our interactions, share our perceptions even with beings that are distinctly different from us. And, that this _difference_ in our personal worldview, our cognitive capacities, and our sensory modalities should be seen as a constitutive aspect of our practices of shared attention. I will articulate attention as a revelatory practice that aids us in discovering a shared world through the plurality, rather than similarity, of our perceptual actions. Attention is, in this sense, not solely driven by subjective intentions; it is also formed and co-constituted by my being addressed by the other. (shrink)

This article discusses China’s attempts to industrialize from the late nineteenth century until the Japanese occupation of 1937. It focuses on the woollen industry and uses data from industrial investigations, market information and company archives. Several attempts to build a woollen industry from the 1880s to the end of the First World War failed. However, in the 1920s and 1930s some private companies in Tianjin, Shanghai and the Yangzi Delta succeeded in managing profitable woollen workshops and mills. An export-based carpet (...) industry was developed in Tianjin while a network of workshops and integrated mills flourished in Shanghai and the Yangzi Delta to supply woollen goods for civilian clothing in the Chinese urban markets. This article aims to contribute to the debate of China’s late industrialization by looking at the structure of the woollen industry and its alignment with actual consumer demands. (shrink)

In a series of influential articles, Rae Langton has argued that Austinian speech-act theory can illuminate the way in which pornography contributes to the subordination of women. I will argue that Langton’s application of Austin is incorrect. In earlier work, I have argued against Langton’s view on the grounds that being subordinated is not the sort of condition that can be brought about through an illocutionary act. In this paper, however, I will set aside that objection and focus instead on (...) Langton’s claims about the type of illocutionary act pornography might be. I will argue, first, that Langton cannot say what she wants to say about the content of pornography and still have it that pornography is a verdictive or exercitive speech act, in Austin’s sense. Verdictive and exercitive speech acts do not, and cannot describe the states of affairs they bring about. Second, I will argue that pornography does not in any case satisfy the conditions necessary for a speech act to be verdictive or exercitive. Specifically, there do not exist accepted background conventions that would give the pornographer authority to render verdicts or to take executive action. This objection to Langton’s view has been made before; I’ll show that her response to the objection betrays a confusion of authority with power. (shrink)

The question "What can justify criminal punishment ?" becomes especially insistent at times, like our own, of penal crisis, when serious doubts are raised not only about the justice or efficacy of particular modes of punishment, but about the very legitimacy of the whole penal system. Recent theorizing about punishment offers a variety of answers to that question-answers that try to make plausible sense of the idea that punishment is justified as being deserved for past crimes; answers that try to (...) identify some beneficial consequences in terms of which punishment might be justified; as well as abolitionist answers telling us that we should seek to abolish, rather than to justify, criminal punishment. This book begins with a critical survey of recent trends in penal theory, but goes on to develop an original account (based on Duff's earlier Trials and Punishments) of criminal punishment as a mode of moral communication, aimed at inducing repentance, reform, and reconciliation through reparation-an account that undercuts the traditional controversies between consequentialist and retributivist penal theories, and that shows how abolitionist concerns can properly be met by a system of communicative punishments. In developing this account, Duff articulates the "liberal communitarian" conception of political society (and of the role of the criminal law) on which it depends; he discusses the meaning and role of different modes of punishment, showing how they can constitute appropriate modes of moral communication between political community and its citizens; and he identifies the essential preconditions for the justice of punishment as thus conceived-preconditions whose non-satisfaction makes our own system of criminal punishment morally problematic. Punishment, Communication, and Community offers no easy answers, but provides a rich and ambitious ideal of what criminal punishment could be-an ideal of what criminal punishment cold be-and ideal that challenges existing penal theories as well as our existing penal theories as well as our existing penal practices. Despite the fact that there is considerable evidence against the causal efficacy of proximal (short-term) conscious intentions, many studies confirm our commonsensical belief in the efficacy of more distal (longer-term) conscious intentions. In this paper, I address two questions: (i) What, if any, is the difference between the role of consciousness in effective and in non-effective conscious intentions? (ii) How do effective conscious distal intentions interact with unconscious processes in producing actions, and how do non-effective proximal intentions fit into this (...) process? I argue that answers to these questions point to a picture of distal conscious intending as a form of self-programming. The metaphor of ?self-programming? will be elucidated by using a distinction between ?structuring? and ?triggering? causes. Though the self-programming metaphor does not amount to a full theory of conscious intending, I argue that it may be a useful heuristic in developing such a theory. I also argue that the metaphor is phenomenologically plausible. (shrink)

The present article commences analyzing the origins and influences of the religious discourse on the configuration of the modern constitutional discourse and the contributions of the jus-positivism in the consolidation of this sacred-civil language. The second issue is the definition of the U.S. Constitution as a mixed and not as a democratic constitution, with regard to the influences of Plato, Aristotle, Cicero and Polybius to the Drafters of the first modern constitutional text; stability and equilibrium took preference over democracy in (...) a wide sense. In ”Embodiment and Epistemology,” Louise Antony considers a kind of ”Cartesian epistemology” according to which, so far as knowing goes, knowers could be completely disembodied, that is, pure Cartesian egos. Antony examines a number of recent challenges to Cartesian epistemology, particularly challenges from feminist epistemology. She contends that we might have good reason to think that theorizing about knowledge can be influenced by features of our embodiment, even if we lack reason to suppose that knowing itself varies relative to such (...) features. She also argues that a masculinist bias can result in mishandling of cognitive differences in cases where they actually exist and she examines a number of the ways in which the maleness of philosophy has, according to feminists, distorted epistemology. Even if a Cartesian approach offers one indispensable part of a comprehensive epistemology, according to Antony, we still need an epistemology that answers questions raised by our everyday, embodied lives. Given Locke’s views on primary and secondary qualities, it seems he is committed to there being real underlying properties in objects, the arrangement and disposition of which underlies and produces the observed properties of that object. It might be natural to think that these primary qualities provide a general system for classifying objects into classes: that we could delineate the real kinds of objects in nature by looking at what their real primary qualities were. A list of the particular qualities (...) of some object would define that object perfectly precisely; by looking at which properties were shared or divergent between this object and others, we group the object with others in the same kind. These real kinds in nature can play several important theoretical roles. They can support real scientific understanding, including inductive inferences (iof things are of the same real kind, then observed properties of one support the inference to unobserved properties of the other); they can form the basis for our judgements about the powers and capacities of particular objects, based on the what other things of that type can do; and these real kinds can provide the meanings for general terms: the thought being that the meanings of class names are empty without real classes to which they correspond. Conflicts of interest are rampant in the American medical community. Today it is not uncommon for doctors to refer patients to clinics or labs in which they have a financial interest (40% of physicians in Florida invest in medical centers); for hospitals to offer incentives to physicians who refer patients (a practice that can lead to unnecessary hospitalization); or for drug companies to provide lucrative give-aways to entice doctors to use their "brand name" drugs (which are much more expensive than (...) generic drugs). In Medicine, Money and Morals, Marc A. Rodwin draws on his own experience as a health lawyer--and his research in health ethics, law, and policy--to reveal how financial conflicts of interest can and do negatively affect the quality of patient care. He shows that the problem has become worse over the last century and provides many actual examples of how doctors' decisions are influenced by financial considerations. We learn how two California physicians, for example, resumed referrals to Pasadena General Hospital only after the hospital started paying $70 per patient (their referrals grew from 14 in one month to 82 in the next). As Rodwin writes, incentives such as this can inhibit a doctor from taking action when a hospital fails to provide proper service, and may also lead to the unnecessary hospitalization of patients. We also learn of a Wyeth-Ayerst Labs promotion in which physicians who started patients on INDERAL (a drug for high blood pressure, angina, and migraines) received 1000 mileage points on American Airlines for each patient (studies show that promotions such as this have a direct effect on a doctor's choice of drug). Rodwin reveals why the medical community has failed to regulate conflicts of interest: peer review has little authority, state licensing boards are usually ignorant of abuses, and the AMA code of ethics has historically been recommended rather than required. He examines what can be learned from the way society has coped with the conflicts of interest of other professionals --lawyers, government officials, and businessmen--all of which are held to higher standards of accountability than doctors. And he recommends that efforts be made to prohibit and regulate certain kinds of activity (such as kickbacks and self-referrals), to monitor and regulate conduct, and to provide penalties for improper conduct. Our failure to face physicians' conflicts of interest has distorted the way medicine is practiced, compromised the loyalty of doctors to patients, and harmed society, the integrity of the medical profession, and patients. For those concerned with the quality of health care or medical ethics, Medicine, Money and Morals is a provocative look into the current health care crisis and a powerful prescription for change. Sam Harris (2010) argues that, given our neurology, we can experience well-being, and that seeking to maximize this state lets us distinguish the good from the bad. He takes our ability to compare degrees of well-being as his starting point, but I think that the analysis can be pushed further, since there is a (non-religious) reason why well-being is desirable, namely the finite life of an individual organism. It is because death is a constant possibility that things can be assessed (...) as “for” or “against” one (Champagne 2011a; Smith 2000). Such an account lets us objectively adjudicate moral questions, as Harris desires. However, by anchoring itself in the mortal body as a whole and not just the brain, such an account dampens the claim that neuroscience would have all the answers. Moreover, it pivots on an affirmation of one’s life that can seem mysterious by regular scientific standards. This chapter thus explains why the trade-off is worthwhile. (shrink)

Several philosophers have argued that ‘constraints’ constrain (and thereby explain) by virtue of being modally stronger than ordinary laws of nature. In this way, a constraint applies to all possible systems, for a variety of possibility that is broader (that is, more inclusive) than the variety we employ when we say that the ordinary laws of nature apply to all physically possible systems. Explanations by constraint are thus more broadly unifying than ordinary causal explanations. Philosophical examples of good candidates for (...) constraints have heretofore been drawn almost exclusively from fundamental physics. This paper argues for the existence of such constraints (even multiple levels of them) in at least one human science (linguistics), not just in physics. (shrink)

"Diversity in the Structure of Christian Reasoning" makes an argument about the nature of interpretive conflicts in modern theology. Using two examples from World Christianity, it examines the hermeneutical changes wrought when scripture crosses cultural boundaries.

This article is an examination of killing in war in its moral and normative dimension – with attention given to how killing affects the acting agent. The author argues against the commonplace belief – often tacitly held if not consciously asserted – among academics, the general public, and even – if surprisingly – military professionals, that killing, including in a justified war, is always morally wrong – even when legally sanctioned and necessary to avert a greater moral wrong. This critique (...) of the “killing is wrong but in war it is necessary” trope is motivated in part by the large numbers of psychiatric battle casualties (specifically moral injury) suffered during operations in Iraq and Afghanistan, and which have attended military activity throughout history. The article approaches the issue through the field of Christian ethical reflection on just war. In building a moral framework for killing in combat, the article explores a typology of homicide, intention, double effect, love, and whether the attitudinal expectations of just warriors in the Christian tradition is realistic in combat. With this moral framework for killing in hand, this article concludes by drawing a critical distinction between moral injury and moral bruising. (shrink)

In this essay I argue that many nonhuman animal beings are conscious and have some sense of self. Rather than ask whether they are conscious, I adopt an evolutionary perspective and ask why consciousness and a sense of self evolved---what are they good for? Comparative studies of animal cognition, ethological investigations that explore what it is like to be a certain animal, are useful for answering this question. Charles Darwin argued that the differences in cognitive abilities and emotions among animals (...) are differences in degree rather than differences in kind, and his view cautions against the unyielding claim that humans, and perhaps other great apes and cetaceans, are the only species in which a sense of self-awareness has evolved. I conclude that there are degrees of consciousness and self among animals and that it is likely that no animal has the same highly developed sense of self as that displayed by most humans. Many animals have a sense of “body-ness‘ or “mine-ness‘ but not a sense of “I-ness.‘ Darwin’s ideas about evolutionary continuity, together with empirical data (“science sense‘) and common sense, will help us learn more about consciousness and self in animals. Answers to challenging questions about animal self-awareness have wide-ranging significance, because they are often used as the litmus test for determining and defending the sorts of treatments to which animals can be morally subjected. Rather than entailing that a particular outcome will occur, many scientific theories only entail that an outcome will occur with a certain probability. Because scientific evidence inevitably falls short of conclusive proof, when choosing between different theories it is standard to make reference to how probable the various options are in light of the evidence. A full understanding of probability in science needs to address both the role of probabilities in theories, or chances, as well as the role of probabilistic (...) judgment in theory choice. In this chapter, the author introduces and distinguishes the two sorts of probability from one another and attempt to offer a satisfactory characterization of how the different uses for probability in science are to be understood. A closing section turns to the question of how views about the chance of some outcome should guide our confidence in that outcome. (shrink)

What is the place of coherence, or structural rationality, in good first-personal deliberation? According to Kolodny (2005), considerations of coherence are irrelevant to good first-personal deliberation. When we deliberate, we should merely care about the reasons or evidence we have for our attitudes. So, considerations of coherence should not show up in deliberation. In response to this argument, Worsnip (2021) argues that considerations of coherence matter for how we structure deliberation. For him, we should treat incoherent combinations of attitudes as (...) off-limits in deliberation. Some important questions are left unanswered by both camps. What do we mean by considerations of coherence “showing up” in first-personal deliberation? How do we interpret the divide between reasons-responsiveness and coherence? How should we interpret cases in which considerations of coherence interact with other norms or requirements? In this paper, I show how Haack’s (1993) crossword puzzle analogy sheds light on these questions. Also, the crossword puzzle analogy allows us to evaluate Kolodny’s objection and identify promising avenues for future research. (shrink)

What is structural rationality? Specifically, what is the distinctive feature of structural requirements of rationality? Some philosophers have argued, roughly, that the distinctive feature of structural requirements is coherence. But what does coherence mean, exactly? Or, at least, what do structuralists about rationality have in mind when they claim that structural rationality is coherence? This issue matters for making progress in various active debates concerning rationality. In this paper, I analyze three strategies for figuring out what coherence means in the (...) debates on structural rationality. I argue that these strategies face problems. (shrink)

This study proposes that Neoplatonism, while not a modern philosophy, is philosophy in the modern sense. Lloyd analyzes the key structures that underlie the dogmas of the Neoplatonic world picture, including the concept of emanation, the return of the soul to the One, the place of mystical knowledge, epistemology, and Porphyry's theory of predication, and shows that they rest on original but intelligible concepts and arguments.

Reasoning from inconclusive evidence, or ‘induction’, is central to science and any applications we make of it. For that reason alone it demands the attention of philosophers of science. This Element explores the prospects of using probability theory to provide an inductive logic, a framework for representing evidential support. Constraints on the ideal evaluation of hypotheses suggest that overall support for a hypothesis is represented by its probability in light of the total evidence, and incremental support, or confirmation, indicated by (...) an increased probability given the evidence than otherwise. This proposal is shown to have the capacity to reconstruct many canons of the scientific method and inductive inference. Along the way, significant objections are discussed, such as the challenge from inductive scepticism and the objection that the probabilistic approach makes evidential support arbitrary. (shrink)
